Deflock Tucson Sends Cease and Desist Letter to UA

The letter from Deflock Tucson, dated October 25, 2025, formally accuses the University of Arizona (UA) of violating the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act (Clery Act) by failing to disclose its use of Flock Safety automated license plate readers (ALPRs) on campus. Although UA Police Department (UAPD) recently updated its internal ALPR policy, Deflock argues that the university’s Annual Security Report (ASR) – a federally required document – omits mention of the 62 Flock cameras and associated data-sharing practices, constituting a lack of transparency and a violation of both federal law and UA’s contract with Flock Safety.

The letter outlines several violations:

  • The ASR fails to include security policies and information about the ALPR system, as required under 34 CFR §668.46(b)(3).
  • UA did not disclose its law enforcement data-sharing agreements with multiple agencies (such as police departments in Flagstaff, Prescott Valley, and others) that have access to Flock data, violating §668.46(b)(4)(ii)(B).
  • These omissions also violate UA’s contractual duty under Section 3.2 of its agreement with Flock Safety, which mandates compliance with all laws.

Deflock adds that the UAPD’s use of ALPRs to “identify witnesses” contradicts Flock’s public claims about how its technology is used. The letter includes examples of public backlash – statements from campus unions, local news coverage, and a growing petition with over 330 signatures – illustrating widespread opposition to the university’s surveillance practices.

Deflock Tucson concludes by demanding that the university immediately suspend all use of Flock ALPR systems until it achieves full compliance with the Clery Act and provides public documentation of transparency. If UA fails to comply within 14 days, Deflock intends to file a formal complaint with the U.S. Department of Education.
